GENERAL CONDITIONS OF SALE 2023
Rates and conditions applicable for the year 2023 concerning the advertising offers of the website www.indeauville.fr, the editions or any other advertising visibility support (screens, videos, films, shop windows, etc.) proposed by the SPL DE DEVELOPPEMENT TERRITORIAL ET TOURISTIQUE - TERRITOIRE DE DEAUVILLE, according to the modalities and rates set out in the insertion orders 2023.
> Partnership : A company that places an order for an advertisement on our media becomes a partner of the SPL TERRITOIRE DE DEAUVILLE for the year 2023.
> Payments: The orders of insertion 2023 are accepted subject to confirmation of the complete payment of the insertions of the previous years. SPL TERRITOIRE DE DEAUVILLE reserves the right to ask for a kbis extract from new partners. SPL TERRITOIRE DE DEAUVILLE reserves the right to ask for a cheque for the total amount of the chosen advertising insertion. A delay in publication or a technical problem with putting the advertisement on line or its visibility cannot lead to any dispute over payment on the part of the advertiser. The invoicing of the advertisements is transmitted to the publication of the brochures or to their setting on line or visibility. In the event of non-payment within the time limits set, SPL TERRITOIRE DE DEAUVILLE is entitled to remove the company concerned from its media without notice.
> Reservations : The SPL TERRITOIRE DE DEAUVILLE reserves the right to refuse, even during the execution of an insertion order, any partnership, advertising, web-pack or other advertising visibility which would appear to it to be incompatible with its quality policy, its tourist interests, its communication strategy or its editorial line, as well as any partnership in the event of non-validity of the supporting documents requested for membership or, for accommodation, in the event of a visit which does not meet the quality criteria for the reception of visitors. SPL TERRITOIRE DE DEAUVILLE may terminate or suspend any partnership in the event of serious and recurrent complaints about an establishment. In this case, the advertising remains due by the advertiser and the prejudice suffered cannot be the subject of any compensation. SPL TERRITOIRE DE DEAUVILLE cannot be held responsible for any interruption in the availability of the www.indeauville.fr website or in the operation or publication of its media beyond its control. No refund will therefore be made.
> Responsibility : All the information, prices, texts and photos transmitted engage the responsibility of the partner advertiser. SPL TERRITOIRE DE DEAUVILLE cannot be held responsible for the various elements provided, nor for any errors, omissions or false information transmitted. If the data and photos sent to SPL TERRITOIRE DEAUVILLE are covered by copyright, the partner advertiser acknowledges that he is the owner of the property rights to these data and photos and grants SPL TERRITOIRE DEAUVILLE the rights to use these data free of charge and non-exclusively and authorizes it to: reproduce or copy the data and/or photos by any means and on any distribution media (brochures, websites, etc.); to adapt and modify them, subject only to the condition of not distorting them and/or altering their quality; to communicate, distribute and publish them by any means and on any medium; to exploit them commercially by any means. The partner advertiser also undertakes to inform SPL TERRITOIRE DE DEAUVILLE in writing of any change in its communication so that it can provide its clients with accurate and up-to-date information.
> Cancellation of advertising: The advertiser partner benefits from 14 clear days following the date of signature of the insertion order to exercise its right of withdrawal. The cancellations of advertising insertion must be sent by registered letter with acknowledgement of receipt to the address indicated at the bottom of the page. After this period, the advertisement will be invoiced in full.
> For the cover pages of the editions, the spaces are allocated on receipt of the completed and signed application form, in the order of arrival at the e-mail address: partenaires@indeauville.fr.
The single advertising inserts of the plans can only be attributed to an establishment of the commune concerned.
For the editions, the advertiser must provide its own advertisement in the required format (digital file HD in PDF) or transmit its elements (texts*, photos* and graphic charter) to the Pôle Partenariats which will be able to make create the advertisement by a graphic designer (paying option. See insertion order).
A print proof will be sent before publication if the advertisement has been designed by the SPL. The signed print order or its acceptance by e-mail justifies the advertiser's agreement. In the case of advertising provided by the advertiser, no proofs will be sent. For the plans, SPL will base itself on the information provided by the advertiser in the insertion order; no proofs of the sections will be sent to the advertiser. For web packs and other web media, the advertiser will be notified when its content is put online and must inform SPL TERRITOIRE DE DEAUVILLE by return of any changes to be made. Under no circumstances can SPL TERRITOIRE DE DEAUVILLE be held responsible if the advertising partner does not carry out this verification. With the exception of the advertising locations specifically provided for in the price list, no specific location can be guaranteed.
> Visuals : The possible expenses of visuals (photos, drawings, logos), films, videos, are the responsibility of the partner advertiser. For the editions, the pictures must be submitted in high resolution (300 dpi minimum - jpg format).
For the web packs, the photos must be in landscape format with a minimum resolution of 72 dpi - format 800 pixels wide x 600 pixels high. If these formats are not respected by the advertiser, SPL TERRITOIRE DE DEAUVILLE will not be able to guarantee a good quality visual reproduction and will not be held responsible. All the elements necessary for the installation of the advertising spaces remain at the disposal of SPL TERRITOIRE DE DEAUVILLE until the brochures are published, during the on-line publication on www.indeauville.fr or during the service on other media.
> Personal data : The data collected on this form is recorded by the SPL du Territoire de Deauville - Quai de l'Impératrice Eugénie - 14800 Deauville, which is responsible for processing it, in the Norman regional and local tourist database managed by the computer tool Tourinsoft of the company FAIRE-SAVOIR - 59650 Villeneuve-d'Ascq; this computer tool makes it possible to respond to all requests for tourist information from the general public and from professionals The legal basis of the processing is the contract - insertion order. The data collected will be communicated only to the managers of the Partnerships and Resources & Means divisions of the SPL du Territoire de Deauville and will be kept for the duration of the advertiser's activity. In accordance with the General Data Protection Regulation (RGPD), you have the right to oppose, access, rectify, limit and delete data concerning you. > Jurisdiction : The signature of the insertion orders implies the acceptance of the above clauses. Any dispute arising from the application of the contracts shall be under the exclusive jurisdiction of the Commercial Court of Lisieux.
